Court sides with Kittery over Mary’s Store demolition

James-CornerKITTERY, Maine – The Mary’s Store property at 40 Old Post Road could be clear for demolition following the Maine Supreme Judicial Court denying the appeal of owner James M. Dineen.

“There was substantial evidence in the record to support the Town Council’s finding of fact and ultimate determination that the Mary’s Store structure constituted a dangerous building,” the decision read in part. “Further after making such a finding, the Town Council did not abuse its discretion in ordering the building to be demolished as the town was authorized by statute to do so.”
