Judge upholds Kittery’s approval of new hotel

ALFRED, Maine — A York County Superior Court judge upheld a Kittery Planning Board decision made last August to approve a Hampton Inn hotel development on Route 1 near the outlet stores.
Judge John O’Neil, Jr. affirmed the Planning Board’s decision a little more than a week after the judge heard oral arguments, about seven months after Richard Balano of Ox Point Drive in Kittery first filed the suit.
The town’s attorney, Duncan McEachern, and the attorney representing the applicant 275 U.S. Route 1, LLC., Durward Parkinson, argued Balano lacked standing to file the appeal and therefore his arguments were invalid.
