ALFRED, Maine — Seven months after the lawsuit was filed, the York County Superior Court finally held oral arguments Friday, May 6, on whether the Kittery Planning Board acted properly when it approved a Hampton Inn development along Route 1 in Kittery last August.

No action was taken by Superior Court Judge John O’Neil, who took the matter under advisement. O’Neil apologized for the long delay in hearing the case.

“I’m given about five civil days a year and I’ve used that up,” he said. “The chief justice asked me to squeeze this case in.”

O’Neil gave each party 10 minutes to make their case.

There are three attorneys in the case: Richard Balano, the Ox Point Drive resident who filed the lawsuit and representing himself; Duncan McEachern representing the Planning Board; and Durward Parkinson representing the building developer.
